Terms and Conditions for Scaffolding Services
1. Scope of Work
KAD Scaffolding will provide scaffolding services as outlined in the project agreement. Any additional services beyond this scope may incur extra charges and will be negotiated separately.
2. Quotations and Payments
- All quotations are valid for a specified period and may be subject to change after this period expires.
- Invoices must be paid upon receipt or as per the pre-agreed payment schedule.
- If the hire period exceeds the quoted timeframe, additional charges will apply.
- Late payments will incur a weekly fee. Interest and compensation may also be applied in line with the Late Payment of Commercial Debts Act 1996. Any reasonable costs incurred in recovering unpaid amounts will be charged.
- Scaffolding will not be dismantled or removed until full payment is received.
3. Cancellation and Rescheduling
- Written notice must be provided at least 7 days before the scheduled start date to cancel or reschedule services.
- Cancellation fees may apply, and any costs already incurred will be charged to the client.
4. Site Access and Conditions
- The client must ensure the site is accessible, free from obstructions, and prepared for KAD Scaffolding’s team, including obtaining any necessary passes or permissions.
- Delays due to site inaccessibility or incomplete paperwork may result in additional charges.
5. Safety and Compliance
- KAD Scaffolding adheres to all applicable safety regulations and standards.
- The client is responsible for maintaining a safe environment and complying with safety protocols.
- Work may be paused if safety concerns arise until the issues are resolved.
6. Insurance and Liability
- KAD Scaffolding holds £10 million in public and employer liability insurance.
- The client is responsible for any damage or theft of scaffolding caused by third parties or their actions.
7. Indemnity
The client agrees to indemnify and hold KAD Scaffolding harmless from any claims, damages, or liabilities arising from the use of the scaffolding.
8. Completion and Acceptance
The project is deemed complete when the scaffolding is removed from the site.
9. Intellectual Property
All designs, plans, or other intellectual property created by KAD Scaffolding remain the company’s property unless otherwise agreed in writing.
10. Dispute Resolution
In the event of a dispute, both parties agree to negotiate in good faith. If unresolved, mediation or arbitration may be pursued.
11. Hire Period and Additional Hire Charges
- Quotations include a standard 4-week hire period unless stated otherwise.
- Additional hire charges apply for extended periods:
- 5% of the total project price per week for weeks 1-8.
- 7.5% per week for weeks 8-12.
- 12.5% per week for periods exceeding 12 weeks.
• All additional hire payments must be made in advance and in full.
12. Inspection of Scaffolding
- KAD Scaffolding inspects scaffolding upon erection and provides a handover certificate valid for 7 days.
- Weekly inspections can be arranged at an additional cost. Otherwise, the client must engage a qualified inspector for ongoing inspections, as legally required.
13. Temporary Roof Scaffolding
- Temporary roofs are not watertight.
- Snow loading complies with BSEN1991-1-3 standards unless a snow management system is implemented by the contractor.
- Monoflex sheeting is installed once and may detach in high winds. KAD Scaffolding is not liable for water damage associated with temporary roofs.
14. Responsibility for Ground and Structure
The client is responsible for ensuring the ground, structure, or base supporting the scaffold is capable of bearing the required loads.
15. Damages During Erection or Dismantling
- KAD Scaffolding takes care during installation, dismantling, and modifications.
- However, certain damages (e.g., cracked tiles during rooftop access) are not covered. KAD Scaffolding will collaborate with the client to address any issues but accepts no liability.
16. Retention of Ownership
All scaffolding remains the property of KAD Scaffolding during the hire period. If payment is overdue, KAD Scaffolding reserves the right to access the site and remove the scaffolding.
17. Entire Agreement
These Terms and Conditions constitute the entire agreement between the parties, superseding any prior agreements, whether written or oral.
18. TV Satellite Signal
Scaffolding may disrupt TV satellite signals. KAD Scaffolding is not responsible for restoring signal. Clients are advised to consult a satellite specialist during installation and dismantling.
19. Gin Wheels, Pulleys, and Ropes
- KAD Scaffolding supplies gin wheels without ropes. Clients must use ropes that have been properly tested and inspected within the last six months and before each use.
- If requested, KAD Scaffolding can supply ropes, which will be inspected prior to installation. However, KAD Scaffolding accepts no liability for damages, injuries, or issues arising from the use of these items.
- Gin wheels provided by KAD Scaffolding are inspected annually by an advanced scaffolding inspector.
- Clients are responsible for ensuring both gin wheels and ropes are inspected by a qualified individual before each use on site.
20. Changes to Terms
These terms are subject to change with prior notice.
